La Cassazione interviene sulla distinzione tra credito "inesistente" e credito "non spettante", rilevante ai fini sanzionatori e per il "raddoppio" dei termini di accertamento e recupero.

Con le attese sentenze 16 novembre 2021, nn. 34444 e 34445 - in cause patrocinate dal nostro studio - la sezione V della Corte di Cassazione interviene con chiarezza nell'annoso dibattito circa la distinzione tra le nozioni di credito "inesistente" e credito "non spettante", rilevante sia ai fini sanzionatori sia per il "raddoppio" dei termini di accertamento/recupero.
La Corte ha stabilito che: "in tema di compensazione di crediti fiscali da parte del contribuente, l'applicazione del termine di decadenza ottennale, previsto dall'art. 27, comma 16, del d.l. n. 185 del 2008 presuppone l'utilizzo non già di un mero credito "non spettante" bensì di un credito "inesistente", per tale ultimo dovendo intendersi - ai sensi dell'art. 13, comma 5, terzo periodo, del d.lgs. n. 471/1997 (introdotto dall'art. 15 del d.lgs. n. 158/.2015) - il credito in relazione al quale manca, in tutto o in parte, il presupposto costitutivo (il credito che non è, cioè, "reale") e la cui inesistenza non è riscontrabile mediante i controlli di cui agli artt. 36-bis e 36-ter del d.P.R. n. 600/1973 e all'art. 54-bis del d.P.R. n. 633/1972".

With the long-awaited judgments nos. 34444 and 34445 of 16 November 2021, section V of the Supreme Court of Cassation clearly intervenes in the long-standing debate on the distinction between the notions of "non-existent" and "not due" credit, which is relevant both for sanctioning purposes and for the "doubling" of the assessment/recovery terms.
The Court ruled that: "with regard to the offsetting of tax credits by the taxpayer, the application of the eight-year limitation period provided for by Art. 27, paragraph 16, of Legislative Decree no. 185 of 2008 ... presupposes the use not merely of a credit that is "not due" but of a credit that is "non-existent", by which it must be understood - pursuant to Art. 13, paragraph 5, third sentence, of Legislative Decree no. 471/1998 - that the taxpayer has used a credit that does not exist. Legislative Decree no. 471/1997 (introduced by Article 15 of Legislative Decree no. 158/.2015) - the credit for which the constitutive condition is totally or partially lacking (i.e. the credit which is not "real") and whose non-existence cannot be ascertained by means of the checks referred to in Articles 36-bis and 36-ter of Presidential Decree no. 600/1973 and Article 54-bis of Presidential Decree no. 633/1972".
